15-YEAR-OLD JAMAR PINKNEY, JR. KILLED BY HIS FATHER FOR RAPING HIS 3-YEAR-OLD HALF-SISTER…

Posted on November 19, 2009. Filed under: News And Politics... |

Family members say a Detroit father led his son by gunpoint to an empty lot in Highland Park, Michigan, forced his 15-year-old son to strip, and shot him in the head.  Highland Park police say they’ve arrested the father, Jamar Pinkney, Sr.

Jamar Pinkney, Jr. was rushed to Henry Ford Hospital where he was later pronounced dead.  The incident began Monday when Pinkney, Sr. arrived at the boy’s mother’s house on North Street in Highland Park.  Apparently, the boy told his mother, Lazette Cherry, that he had improper sexual contact with his father’s girlfriend’s 3-year-old daughter (who happens to be his half-sister).  She then called and told his father because, as she stated, "This isn’t something you sweep under the rug,"  Family members say the two argued before the father pulled out a gun and ordered the teen out of the house.

The family is outraged, calling the father a murderer.  Why aren’t they outraged by the fact that this 15-year-old raped his half-sister?  People may hate me for saying this, but I can understand the outrage of this father, but I can’t condone killing his son because of it.  If it were up to me, I would have castrated the little dirtbag.  I hope the judge goes easy on the father, but I wonder why the kid’s mother didn’t reach out to him when he confessed to her.  I would have seen this as a desperate plea for help.  Maybe if she got him the proper attention he needed in dealing with this, it wouldn’t have escalated to this, but we’ll never know.  On the other hand, he did rape his 3-year-old half-sister, and that is extremely troubling to me.  My feelings and sympathy fade for this kid when I think of the pleasure he had at the expense of a 3-year old baby, and at 15, he’s old enough to know better.  Maybe intervention wouldn’t have helped him because in most cases, rapists are repeat offenders.  Why can’t they be castrated for the animals that they are?

Highland Park Police said Jamar Pinkney Sr.,right, marched his naked son Jamar Jr. from a home Monday near Rosa Parks and North and into a grassy field where he forced the teen to kneel. He then shot the boy in his head, police said.

Lazette Cherry, left, 36, mother of Jamar Pinkney Jr., is consoled by her sister, Yolanda Cherry, during a hearing in 30th District Court in Highland Park on Wednesday. The teen’s father was charged in the boy’s slaying.

HIGHLAND PARK, Mich. – The family of slain 15-year-old Jamar Pinkney Jr. was overcome with emotions Wednesday as his father was led into court and arraigned on first-degree murder charges in his death.

Police said Jamar Pinkney Sr. forced his son, Jamar Pinkney Jr., to get naked and then he led him out of his mother’s Highland Park home Monday and shot him execution-style in the head in a nearby field.

Jamar Pinkney Sr. was charged with first-degree murder, which carries a maximum penalty of life in prison without chance for parole. He was also charged with three counts of felonious assault and felony firearm.

Highland Park Judge Bridgette Officer arraigned the 37-year-old on the charges Wednesday afternoon in 30th District Court. Jamar Pinkney Sr. pleaded guilty at the arraignment.

"In the event that there’s evidence that he did do this…that’s something that either a jury or a judge would have to take a good, hard look at," said the defendant’s attorney, Corbett Edge O’Meara.

A judge ordered the father held without bond and set a preliminary examination for Dec. 1.

"You seen the look on this face, no expressions or nothing, just a cold-hearted murder," said one of the victim’s family members outside the courtroom Wednesday.

The victim’s mother and her sister told police that Jamar Pinkney Sr. came into the home Monday afternoon with a gun and began arguing with his son.

Family members said the argument stemmed from a confession made by the son. According to Jamar Pinkney Jr.’s family, the teen told his mother that he’d touched his 3-year-old half-sister inappropriately at his father’s Detroit home.

The toddler is his father’s daughter with another woman.

Jamar Pinkney Jr.’s aunt Yolanda Cherry told Local 4 she was in the home during the argument.

"He beat my nephew real bad in the head, where he had knots like he had been in a boxing ring," said Cherry.

When Cherry tried to intervene, she said, the father pulled out a gun.

"I ran down the street to get police down here and I heard a gunshot," said Cherry.

Witnesses at the scene told Local 4 that they saw Jamar Pinkney Sr. order the naked teen out of the home and to an empty field.

A woman who did not want her identity revealed told Local 4 what she saw.

"He brought him out the house, he walked him over there and said, ‘Get on the ground,’ and he’s like, ‘No, Daddy, no, Daddy,’ and next thing you know, he grabbed his head and he shot him," said the witness.

The witness said the father calmly got into his vehicle and drove away.

"He was calm and drove off like a regular person, like he didn’t do anything, and I am like, ‘wow,’" said the witness.

Police were looking for the father after he fled the area. He was caught a few hours later.

"Whatever my grandson did there, there is nothing in this world that was worth taking his life. He got him down on his knees and killed him," said the boy’s grandfather.

"No individual has the right to exact the death penalty on another, no matter how reprehensible the behavior. That is why we have laws," said Wayne County Prosecutor Kym Worthy.

Jamar was a sophomore at Martin Luther King High School. Family members said he was active in sports.

Jamar Pinkney Jr.’s aunt Janice Burkes said she doesn’t believe the allegations of molestation because her nephew was a sweet boy and very good with kids.

"No I can’t believe that I think. It’s a bunch of crap," said Burkes.

A candlelight vigil for the victim was held Tuesday evening in Highland Park. His funeral has been set for Monday.

A fund has been set up to help the family with burial expenses. Donations can be made at the Charter One Bank branch in Highland Park.

To both Alison and Joanne:

I wrote this post on November 19, 2009 and did not see the comment by Alison (sorry, Alison) seven months later when she posted it. I had my blog on Windows Live and there wasn’t any way to monitor past post remarks. Now that I have WordPress, I hope to be able to address any incoming comments that require answering…

With that said, I stand by my words. Your words are a classic repeat of Whoopi Goldberg’s line, “It wasn’t rape-rape.” To me, it was. There are different interpretation of rape, as Wikipedia points out…

According to http://en.wikipedia.org/wiki/Rape, there is a section that states:

“The term sexual assault is closely related to rape. Some jurisdictions define “rape” to cover only acts involving penile penetration of the vagina, treating all other types of non-consensual sexual activity as sexual assault. The terminology varies, with some places using other terms. For example, Michigan, United States uses the term “criminal sexual conduct”.[8] In some jurisdictions, rape is defined in terms of sexual penetration of the victim with or without penetration of objects.[9] Some jurisdictions also consider rape to include the use of sexual organs of one or both of the parties, such as oral copulation and masturbation. The victim does not have to be penetrated to be raped; the perpetrator can use objects to stimulate the genitals. The perpetrator can use their hand to stimulate the genitals. The perpetrator can use drugs (including alcohol) to incapacitate the victim.”

There are different interpretation to this story as well…

This story states: “The incident was sparked by allegations that the younger Jamar Pinkney had ‘sexual contact’ with a three-year old. The boy’s mother, Lazette Cherry, confirmed to the Detroit Free Press that her son had admitted the incident to her, at which time she involved the elder Pinkney.”

Somehow this story is divided between sympathy for the father and sympathy for the son. They were both wrong! At fifteen, he was certainly not a child and did know the difference between right and wrong. Yes, the father did a barbaric thing, and I am also mortified that he had the gall to kill his son in cold blood, but I really don’t think he was in his right mind when he shot him. I don’t know what I would have done under similar circumstances as I’ve never been in a situation like this, thank God!

According to “Michigan vs. Jamar Pinkley” on CNN’s In Session….

“The defense, though, says the man who walked through the door was not a cold and calculating killer, but someone in great turmoil. Over an excruciating period of some twenty hours, Pinkney Sr.’s son had lied, then told half-truths, and finally came clean about vaginally raping his little sister, his attorneys say, causing the father to lose control. (Jamar Jr.’s mother denies that her son said this).”

We’ll never know the complete details—only the mother, father and God knows that. Reading all the press on this story, I find that inconsistencies abound. Suspiciously absent from some of the coverage is the fact that the toddler was Jamar’s half sister; the mother left that part out many times. Also absent is the term she used early on that her son had “sexual contact”. It changed to “inappropriate touching”, etc., then Jamar Pinkney Jr.’s aunt Janice Burkes came forward and said she didn’t believe the allegations of molestation because her nephew was a “sweet boy” and very good with kids. What mother wouldn’t defend her kid even if they were wrong. I’ve seen it done hundreds of times.

We could go on and on about this case and others like it. Unfortunately, the real victim here is too young to defend herself, and my thoughts and prayers are with her. She will have to live with what happened to her for the rest of her life, and I hope her family has the good sense to get her the help she will need as she grows up. Maybe this tragedy will educate people as to the horrors and repercussions of this type of behavior, despicably portrayed by both the father and the son…

INNOCENT UNTIL PROVEN GUILTY.AND THE CHILD WAS MURDERED BEFORE ANYTHING WAS PROVEN. HAVE YOU STOPPED TO THINK THAT IF THAT CHILD DID WHAT HE DID MAYBE HE WAS MOLESTED OR HAD SOME TYPE OF PROBLEMS. WHEN CHILDREN OF THE SAME AGE EXPLORE EACH OTHER SEXUAL LYNN IT’S LEGAL.WHEEN IT BECOMES AN AGE ISSUE IT BECOMES ILLEGAL. REGARDLESS NO ONE HAS THE RIGHT TO TAKE THE LIFE OF ANOTHER. I WORKED WITH MOLESTED AND ABUSED CHILDREN FOR TEN YEARS IN A RESIDENTIAL TREATMENT FACILITY.

Don’t start yelling at me, Yolanda. I’m not the one who killed that boy. Throw your rant to where it belongs–onto his father…
On another note, your job is a really tough job, and I applaud you for it. I just hope you don’t go into a rant in these situations because it’s times like those that they need a level head not a hot-head…
